Terms & Conditions

  1. Definitions

In these Terms and Conditions:

-  “Company”, “we”, “us”, or “our” means Ladder Warehouse Pty Ltd.

-  “Customer”, “you”, or “your” means any person or entity purchasing goods or services from us.

- “Goods” means ladders, scaffolding, gantry systems, and other access equipment supplied by us.

- “Services” means repairs, inspections, certifications, and related services provided by us.

​  2. Acceptance of Terms

By purchasing Goods or Services from us, whether in person or online, you agree to be bound by these Terms and Conditions.

  3. Compliance with Law

Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law, including consumer guarantees that cannot be excluded.

  4. Website Use

4.1  You agree to use this website only for lawful purposes.
4.2  You must not:

(a) misuse, interfere with, or disrupt the website;
(b) attempt unauthorised access to systems or data;
(c) transmit malicious software or harmful code;
(d) use the website in a way that may damage our reputation.

4.3  We may suspend or restrict access to the website at any time without notice.

  5. Intellectual Property

5.1  All content on this website, including text, images, logos, branding, and design, is owned by or licensed to us.
5.2  You must not reproduce, distribute, modify, or exploit any content without our prior written consent.
5.3  Unauthorised use may result in legal action.

  6. Sale of Goods

6.1  All Goods are supplied subject to availability.
6.2  Prices are listed in Australian Dollars (AUD) and may be changed without notice.
6.3  We reserve the right to refuse or cancel any order at our discretion.
6.4  Risk in the Goods passes to the Customer upon delivery or collection.
6.5  Title in the Goods does not pass until full payment has been received.

  7. Delivery and Collection

7.1  Delivery timeframes are estimates only.
7.2  We are not liable for delays outside our control.
7.3  The Customer is responsible for ensuring safe access for delivery.

  8. Use of Goods and Safety

8.1  All Goods must be used strictly in accordance with manufacturer instructions and applicable Australian Safety Standards (AS1892, AS1576 and AS1657).
8.2  The Customer is responsible for ensuring that:

(a) the Goods are suitable for their intended purpose;
(b) the Goods are inspected prior to each use;
(c) all users are properly trained in safe operation.

8.3  We are not responsible for any injury, loss, or damage resulting from misuse, improper setup, or failure to follow

safety guidelines.

  9. Compliance with Standards

9.1  Goods supplied by us comply with relevant Australian Standards (AS1892, AS1576 and AS1657) at the time of supply where applicable.
9.2  Ongoing compliance and maintenance of Goods is the responsibility of the Customer after purchase.

  10. Repairs and Maintenance Services

10.1  Repairs are based on the visible and accessible condition of the Goods at the time of assessment.
10.2  We do not guarantee the identification of all defects, including hidden or latent faults.
10.3  Any advice or recommendations provided are based on information available at the time.
10.4  Repaired Goods must be inspected and used responsibly by the Customer after return.

  11. Inspection and Certification Services

11.1  Inspection and certification reports reflect the condition of the equipment at the time of inspection only.
11.2  Certification does not guarantee future performance or safety of the equipment.
11.3  The Customer is responsible for ongoing inspections and compliance after certification.

  12. Quotes and Authorisation

12.1  All quotes are valid for 30 days unless otherwise stated.
12.2  Quotes are estimates only and may vary based on actual work required.
12.3  Work will not proceed without Customer approval.
12.4  We reserve the right to charge storage or disposal fees for uncollected Goods after a reasonable period as communicated by us.

  13. Warranty

13.1 Goods may come with manufacturer warranties where applicable.
13.2 We warrant our repair workmanship for a period of 6 months from completion.
13.3 This warranty does not cover:

(a) misuse or abuse;
(b) overloading;
(c) unauthorised modifications;
(d) normal wear and tear.

  14. Returns and Refunds

14.1  Returns are accepted in accordance with Australian Consumer Law.
14.2  Change-of-mind returns may be refused or subject to conditions.
14.3  The Customer is responsible for return shipping unless otherwise agreed.

  15. Limitation of Liability

15.1  To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential loss.
15.2  We are not liable for any injury, damage, or loss arising from:

(a) misuse or improper use of Goods;
(b) failure to maintain or inspect Goods;
(c) use outside intended purpose.

15.3  Where liability cannot be excluded, our liability is limited to:

(a) repair or replacement of the Goods; or
(b) refund of the purchase price; or
(c) re-supply of the Services.

  16. Indemnity

The Customer indemnifies and holds us harmless against any claims, damages, or losses arising from improper use, handling, or modification of the Goods.

  17. Workplace Use

17.1  Where Goods are used in a workplace, the Customer is responsible for compliance with all applicable workplace health and safety laws.
17.2  This includes ensuring:

(a) regular inspections;
(b) employee training;
(c) safe systems of work.

  18. Third-Party Products and Services

We are not responsible for the performance or safety of third-party products not supplied or serviced by us.

  19. Website Use (Online Sales)

19.1  We make reasonable efforts to ensure website accuracy but do not guarantee completeness or accuracy.
19.2  We may update or discontinue products or services at any time.

  20. Privacy

We handle personal information in accordance with our Privacy Policy and the Privacy Act 1988.

  21. Termination

We reserve the right to refuse service or terminate transactions at our discretion.

  22. Governing Law

These Terms and Conditions are governed by the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland.

  23. Changes to Terms

We may update these Terms and Conditions at any time. Continued use of our services or website constitutes acceptance of the updated Terms.
